Haverford OKs zoning for medical marijuana facilities
Haverford Commissioners approved the first reading of an ordinance that adds provisions to the zoning code for medical marijuana dispensaries and grower/processor facilities, as required by the Pennsylvania Medical Marijuana Act signed into law April 2016. The ordinance permits medical marijuana dispensaries as a conditional use in Shopping Center Commercial Districts (C-5), when authorized by the board after review by the Planning Commission. Additionally, medical marijuana grower/processing facilities would be permitted as a conditional use in Light Industrial Districts (LIN). Haverford’s ordinance prohibits dispensaries from locating within 1,000 feet of a boundary for any institutional zoning district or the property line of any parcel containing an institutional zoning use, “including but not limited to public, private and parochial schools and day care centers.” The ordinance further requires that a dispensary have a single secure public entrance and appropriate security measures. A dispensary cannot be located less than 1,000 feet from the next dispensary. Provisions include regulations for growers/processors regarding emissions and waste disposal. Commissioner Kevin McCloskey said it’s important for the public to understand that commissioners are reacting to state law that was passed and taking the opportunity to enact zoning restrictions. “It’s a zoning issue. We’re not voting on medical marijuana,” McCloskey said. A second and final reading of the ordinance will be scheduled in May.
